Council blocks birthday party over noise

Birmingham City Council has blocked a late-night birthday party for fewer than 40 people over concerns it would be too noisy.

Flamingo Cafe and Restaurant, between Gib Heath and Lozells, issued a temporary event notice for regulated entertainment and alcohol sales in order to host the party from 11pm on October 19, until 4am the following morning.

They stated 35 people maximum would be in attendance including staff, whilst there would also be three security guards present.

But Martin Key, environmental protection officer at the Birmingham City Council, objected.

He argued to a licensing sub committee on Wednesday that there were homes directly above the restaurant on Villa Road which itself was not located in a typical ‘late night activity area’.

Mr Key also raised concerns about whether the building had proper noise insulation and the fact there was no designated smoking area for the event.

He concluded saying the party would likely cause a ‘public nuisance’ particularly for those living above the venue and said: “Our concern would be any kind of regulated activity for a party would normally involve elevated levels of noise and this building has no noise mitigation.”

Following a short 10 minute hearing the committee ruled to issue a counter notice blocking the event.

No-one from Flamingo attended the meeting which heard they had sent in a note claiming the music would only be at ‘background’ levels.

The restaurant has been approached for comment.
