Desi Roti and Khana, in Cape Hill, Smethwick, was closed after the rodents were discovered during a routine hygiene inspection last year.

And last Thursday owner Abid Hussain admitted four food hygiene charges and was fined at Wolverhampton Magistrates Court.

Hussain pleaded guilty to failing to keep a food premises clean, failure to protect food against contamination, failure to have adequate procedures in place to control pests, and failure to implement and maintain a food safety management system.

He was fined £2,000 for each of the offences and told to pay a victim surcharge of £170 as well as full costs to Sandwell Council of £1,439.59.

The takeaway, on the corner of the A4092 and Montague Road, closed voluntary after the Sandwell Environmental Health inspection on October 9 last year.

Hussain must now pay his total bill of £9,609.59 within 14 days after the court made a fines collection order.

Councillor Elaine Costigan, the cabinet member for public health and protection at Sandwell Council, said: "Sandwell Council always takes food hygiene matters very seriously.

“We do work to support food businesses but in this instance, officers had no alternative but to take enforcement action because of the imminent risk of heath to the public.

"We welcome this sentence and hope that it acts as a deterrent to other food businesses that do not manage their businesses in compliance with the law.”
