Father jailed over two-month-old baby's death to stay behind bars as appeal fails

A father who was jailed over the death of his two-month-old baby has had an appeal against his conviction dismissed.

Luke Morgan was jailed last year over the death of his son Tyler who suffered broken ribs and was smothered at the family home in Sunnymead Road, Burntwood, in 2014.

He will stay behind bars after it was announced his appeal, which was heard by senior judges last month, had failed.

Morgan, 27, was convicted of causing or allowing Tyler’s death and child cruelty along with mother Emma Cole.

Luke Morgan and Emma Cole were locked up for eight years and five years respectively

They were both cleared of murder and manslaughter.

Morgan was jailed for eight years and Cole was locked up for five years.

It is understood Cole also wanted to appeal her conviction but her attempt failed before making it to the Court of Appeal.

During the trial, the court heard Morgan had bitten baby Tyler on the forearm.

Judge Michael Chambers said he believed one of the parents deliberately smothered Tyler.
