Home takeaway plan rejected by planners

A Walsall resident’s bid to open up a takeaway business from his own home has been thrown out by council planners.

Walsall Council had received an application from Syed Shah requesting a lawful development certificate to operate a delivery only takeaway business from the property in Herberts Park Road, Darlaston.

Mr Shah said he was looking into opening a commercial business at a later date but wanted to test the viability of the business.

His intention was to open from 11am to 2pm and then 5pm to 10pm each day.

But his plan was rejected by authority who said the smell and increased noise would have a negative impact on neighbours.

In his application, Mr Shah said: “I would like to start food takeaway business – delivery only – from home.

“I’m not doing massive cooking as I would like to sell some light snacks, for example wraps, fries, nuggets, sandwich, pasta, chicken salad, cold drinks and shakes.

“The business is mainly focusing on only delivery service as there will be no customers coming in or out the property and also the food production is not on a massive level.

“So neighbours will not be disturbed from any activity as the food will be prepared inside the home kitchen.”

He added: “As I have plans to buy a commercial space later to run a successful takeaway business I would like to see what is the demand available in the market for my business. Also, I don’t want to spend lot of money initially.”

The planning decision said: “The proposed use of the house for a hot food preparation and delivery service – to operate seven days a week and during evenings – would go beyond that which is incidental to the enjoyment of the dwelling.

“It is considered the proposed use would result in a rise of disturbance to adjoining neighbours from increase traffic movements, noise and cooking odours to the detrimental impact of the neighbours’ amenity.”
